HO2 Special Terms of Sale

These HO2 Special Terms of Sale are in addition to, and will take precedence over, the Auction Terms & Conditions of Business and Heffel's Code of Business Conduct, Ethics and Practices. These HO2 Special Terms of Sale and Auction Terms and Conditions of Business represent the terms upon which the Auction House contracts with the Consignor and, acting in its capacity as agent on behalf of the Consignor, contracts with the Buyer. These Terms shall apply to the sale of the Lot by the Auction House to the Buyer on behalf of the Consignor, and shall take precedence over any previously agreed Terms. These Terms are hereby incorporated into and form part of the Consignment Agreement entered into by the Auction House and the Consignor.

HO2 auctions are single consignor sales from corporate collections. These speciality corporate collection sales will run for two weeks on select months of the year.

All Lots are sold on an "as is" basis. The Auction House provides no warranties with respect to the state of the Lot. The Buyer accepts full responsibility to inspect the property prior to the conclusion of the auction and accepts the property in its actual physical condition and at the location specified.

a.

Works, where framed, were not removed from their frames for the purposes of cataloguing. In cases where the back of the physical work is covered by framing verso will indicate the back of the frame. The dimensions reflect the image size and do not include margins or frames.

b.

The Buyer shall be responsible for ascertaining the condition of the Lot and the frame. Additional images, beyond those posted on www.heffel.com, and condition reports will not be provided by Heffel. Frames may have defects and may not be noted on our website.

Works will be available for preview at designated times and locations and by prior appointment. Preview appointment requests must be received a minimum of 24 hours in advance of the scheduled preview hours, and will be limited to specific Lots of interest and a maximum of 10 Lots per appointment. Please email previewrequest@heffel.com to schedule the appointment.

If necessary, all telephone and absentee bid forms should be submitted to bids@heffel.com and by submitting a telephone or absentee bid form, the bidder is agreeing to the HO2 Special Terms of Sale.

The Registered Bidder and Buyer authorizes the Auction House to provide to the Consignor a listing that shall include their name as a person claiming to be a qualified employee or annuitant of the current Consignor for verification thereof.

The Buyer shall pay in full and collect the Lot from the designated location by 4:30 p.m. on the seventh (7th) day following the date of the auction sale, after which date the Buyer shall be responsible for all Expenses until the date the Lot is removed from the preview venue. Storage charges will commence following the seven (7) day period and will be payable directly to the third party storage company nominated by Heffel.

7.

Heffel does not insure works valued under $2,000, ceramics, frames or glass during transit.

All representations or statements made by the Auction House, or in the Consignment Agreement, or in the catalogue or other publication or report, as to the authorship, origin, date, age, size, medium, attribution, genuineness, provenance, condition or estimated selling price of the Lot, are statements of opinion only. The Buyer agrees that the Auction House shall not be liable for any errors or omissions in the catalogue or any supplementary material produced by the Auction House.

Payment & Pick-Up

The Buyer shall pay in full and collect the Lot from the designated location by 4:00 pm ET on the scheduled payment and pick-up dates noted below (for each corresponding sale), after which date the Buyer shall be responsible for all Expenses until the date the Lot is removed from the storage venue. Storage charges will commence following the designated pick-up dates and will be payable directly to the third-party storage company selected by Heffel.

Payment must be made by: a) Bank Wire direct to the Auction House’s account, b) Certified Cheque or Bank Draft or c) a Personal or Corporate Cheque. All Certified Cheques, Bank Drafts and Personal or Corporate Cheques must be verified and cleared by the Auction House’s bank prior to all purchases being released. The Lot(s) will not be released unless it is paid for in full. Waiting for clearance could impact the purchaser’s ability to retrieve the work on the designated pick-up dates.

The Auction House honours payment by Debit Card or by Credit Card limited to VISA or MasterCard. Credit Card payments are subject to acceptance and approval by the Auction House and to a maximum of $5,000 if the Buyer is providing his Credit Card details by fax, or to a maximum of $25,000 if the Credit Card is presented in person with valid identification. Such Credit Card payment limits apply to the value of the total purchases made by the Buyer and will not be calculated on individual transactions for separate Lots. In all circumstances, the Auction House prefers payment by Bank Wire transfer.

Consolidated Shipping Options

If the purchaser would like their Lot(s) to be included in a consolidated shipment to a Heffel office outside of Toronto (ie: Vancouver, Montreal or Calgary) they must complete and submit a shipping form to melina@heffel.com within five business days of the close of the sale. If the form is not submitted with complete details within this time period, the work will not be included in the shipment. Not all shipping options (including quotations and insurance) listed on Heffel's standard shipping form are available for works sold through HO2. Consolidated shipment is offered at a standard rate contingent on the total size of the work (including the frame). Provincial taxes apply to the following shipping charges, which are based on the dimensions of the entire work including the frame.

Local Couriers

Clients who are local or in areas outside of the consolidated shipping delivery locations are required to either retrieve their purchased Lot(s) in person or independently organize for a courier service to retrieve the Lot(s) on their behalf. All purchase pick-ups (by purchasers or chosen courier services) may take place only during designated pick-up dates. The Purchaser must notify Heffel of a courier pick-up, and provide authorization to release the work. Please either call Heffel Toronto at 416 961 -6505 or email authorization to melina@heffel.com.
